1. Definitions & Acceptance

These Terms of Service ("Terms") govern your access to and use of Lingofable's mobile application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

Key Definitions:

• Service: Lingofable's AI-powered language learning platform, including mobile app, website, and all features
• User/You: Any person or entity using the Service
• Content: Stories, translations, images, audio, and all materials provided through the Service
• AI-Generated Content: Content created using artificial intelligence services from OpenAI and other providers
• Premium Features: Paid subscription features including unlimited stories and audio narration

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Your continued use after such changes constitutes acceptance of the updated Terms.

2. Description of Service

Lingofable is an AI-powered language learning platform that uses comprehensible input methodology through interactive stories. Our Service includes:

• AI-generated interactive stories in multiple languages
• Vocabulary tracking and progress analytics
• Audio narration of stories
• Comprehensibility scoring based on your vocabulary knowledge
• User feedback and rating features

Third-Party AI Services: We use the following third-party services to provide our features:

• OpenAI: Story generation, translations, and image generation (DALL-E)
• Inworld AI: Text-to-speech audio narration
• Supabase: Authentication, database storage, and file hosting
• PostHog: Analytics and usage tracking

Features marked as "beta" are experimental and may be modified or discontinued without notice.

3. Account Registration & Eligibility

Age Requirement: You must be at least 13 years old to use Lingofable. Users between 13 and 17 years old must have parental or guardian consent to use the Service.

Account Responsibility: When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized account access
• Not share your account with others
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion. You may delete your account at any time by contacting support.

4. Subscription Plans & Payment

Subscription Tiers:

• Free Tier: Limited story access and basic features
• Premium Tier: Unlimited stories, audio narration, and advanced analytics

Payment Terms:

• Subscription fees and pricing are displayed in the app and on our website
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel your subscription at any time through your account settings

Refund Policy: Subscription fees are generally non-refundable except as required by applicable law or approved on a case-by-case basis at our discretion. If you believe you are entitled to a refund, contact us at team@lingofable.com.

5. AI-Generated Content & Accuracy Disclaimer

IMPORTANT: All stories, translations, images, and audio on Lingofable are generated using artificial intelligence services. While we implement quality controls, AI-generated content may contain errors.

How We Generate Content:

• Stories: Generated using OpenAI GPT models with human review
• Translations: Generated using AI with human review when available
• Images: Generated using OpenAI DALL-E image generation
• Audio: Generated using Inworld AI text-to-speech technology

Content Safety & Quality Measures:

• All story and image generation is guided by built-in content guardrails that prohibit graphic violence, nudity, hate symbols, and other inappropriate material
• Cover images follow strict safety guidelines designed to be appropriate for all users, including restrictions on distressing depictions of children, body horror, and suicide-adjacent imagery
• Story content is adapted to the learner's language proficiency level, with vocabulary complexity and themes appropriate to each CEFR level
• Character names and appearances are drawn from culturally diverse, regionally authentic pools to ensure respectful and varied representation across stories
• We periodically audit generated content for quality, safety, and accuracy

Accuracy Limitations:

• AI-generated content may contain grammatical errors, factual inaccuracies, or cultural insensitivities
• Translations may not perfectly capture nuance, idiomatic expressions, or context
• Images and audio may contain artifacts or unnatural elements
• Human review reduces but does not eliminate these risks

YOU ACKNOWLEDGE AND AGREE: We do not guarantee 100% accuracy of any AI-generated content. You should not rely on Lingofable content for critical decisions and should verify important information independently. We are not responsible for errors, omissions, or consequences arising from AI-generated content.

6. Educational Disclaimers & Learning Outcomes

IMPORTANT: Lingofable is an educational tool designed to support language learning through comprehensible input. However, learning outcomes vary significantly based on individual factors.

What We Do NOT Guarantee:

• Language fluency or proficiency at any level
• Achievement of specific CEFR (Common European Framework of Reference) levels
• Specific learning outcomes or timeframes
• Equivalence to formal language education, tutoring, or immersion programs
• Professional certification or accreditation

Factors Affecting Your Results:

• Your effort, consistency, and time commitment
• Prior language learning experience and knowledge
• Individual cognitive and learning differences
• Use of supplementary learning resources and methods

Our Recommendation: Use Lingofable as part of a comprehensive language learning strategy that may include formal classes, conversation practice, immersion experiences, and other resources. Our comprehensibility scoring is algorithmic and not certified by educational authorities.

WE ARE NOT LIABLE for any lost time, opportunity costs, or failure to achieve desired learning outcomes through use of the Service.

7. Analytics

PostHog Analytics: We use PostHog analytics to understand how users interact with Lingofable, monitor application health, and improve our Service. This includes collection of usage data, error reports, and performance metrics.

What We Collect:

• Usage Analytics: Features used, stories read, reading patterns, session duration, and screen views
• User Interactions: Clicks, taps, and feature usage
• Performance & Error Monitoring: App performance, crash reports, and error diagnostics

Your Choices: You may opt out of analytics tracking by contacting us at team@lingofable.com. Note that opting out may limit our ability to provide personalized features and support.

8. Intellectual Property Rights

Lingofable's Ownership:

The Service, including all AI-generated stories, images, audio, and translations (collectively, "Platform Content"), is the proprietary property of Lingofable and its licensors. Platform Content is protected by copyright and other intellectual property laws.

Limited License to You:

Subject to your compliance with these Terms, Lingofable grants you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and view the Platform Content solely for your personal, non-commercial language learning purposes.

Restrictions. You may not:

• No Unauthorized Use: Do not copy, distribute, modify, or commercially exploit any stories or content without our express permission.
• No Scraping or Competition: Automated scraping, bulk downloading, or using our content to build competing databases or services is strictly prohibited.
• No AI Training: Our content may not be used to train, fine-tune, or develop machine learning or artificial intelligence models.
• Preserve Attribution: You must not remove or alter any copyright notices, branding, or attributions from the content.

Your Data: You retain ownership of your vocabulary data, reading progress, and personal information. By using the Service, you grant us a license to use this data to provide personalized features and improve the Service.

9. Prohibited Uses

You agree NOT to:

• Use bots, scrapers, or automated tools to access the Service
• Reverse engineer, decompile, or attempt to extract source code
• Bypass paywalls, access controls, or security measures
• Impersonate others or create fake accounts
• Interfere with or disrupt the Service's operation or infrastructure
• Use the Service for any illegal, fraudulent, or malicious purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Platform Content as a data source for large language models (LLMs) or other artificial intelligence systems.
• Resell, redistribute, or commercially exploit the Service without a license
• Violate any applicable laws, regulations, or third-party rights

Violation of these prohibitions may result in immediate account termination and legal action.

10. Third-Party Content & Open-Source Data

Certain features of the Service incorporate third-party data sources that are made available under open-source or Creative Commons licenses. By using the Service, you acknowledge the following attributions:

11. Third-Party Services & Data Sharing

To provide the Service, we rely on the following third-party providers:

Third-Party Terms: Each third-party service operates under its own terms of service and privacy policy. We are not responsible for the practices, policies, or security of third-party providers. We are not liable for any data breaches, service outages, or issues caused by third-party services.

11. Service Availability & Modifications

Availability:

• We do not guarantee 100% uptime or uninterrupted access to the Service
• The Service may be unavailable due to maintenance, updates, or technical issues
• We will provide advance notice of scheduled maintenance when possible
• We are not liable for downtime, data loss, or service interruptions

Modifications:

• We reserve the right to modify, suspend, or discontinue any feature at any time
• Beta features may be changed or removed without notice
• We may update these Terms; material changes will be communicated to users
• Your continued use after modifications constitutes acceptance of changes

12. Account Termination & Data Retention

Voluntary Termination:

• You may delete your account at any time by contacting team@lingofable.com
• Account deletion requests are processed within 30 days
• Upon deletion, your personal data will be anonymized or permanently deleted
• Some data may be retained for legal compliance or fraud prevention

Termination by Lingofable:

• We may suspend or terminate accounts for violations of these Terms
• We may terminate accounts for any reason at our discretion with notice
• Termination for cause (Terms violations) is effective immediately
• No refunds are provided for terminations due to Terms violations

Data Retention:

• Personal data: Deleted within 30 days of account deletion
• Analytics data (PostHog): Retained according to our data retention policy
• Legal compliance data: Retained as required by law
• Aggregated, anonymized data: May be retained indefinitely for research and improvement

13. Limitation of Liability & Disclaimers

PLEASE READ THIS SECTION CAREFULLY - IT LIMITS OUR LIABILITY.

Service Provided "AS IS":

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that the Service will be error-free, secure, or uninterrupted
• We do not warrant the accuracy, completeness, or usefulness of any content

What We Are NOT Liable For:

• AI Content Errors: Inaccuracies, mistakes, or harmful content in AI-generated stories, translations, images, or audio
• Learning Outcomes: Failure to achieve language fluency, proficiency, or educational goals
• Lost Time or Opportunity: Time spent using the Service or lost opportunities
• Third-Party Services: Failures, outages, or security breaches by OpenAI, Inworld AI, Supabase, or PostHog
• Data Loss: Loss of user data, progress, or content due to any cause
• Indirect Damages: Consequential, incidental, special, or punitive damages

Maximum Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, our total liability to you for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD if you are on the free tier, whichever is greater.

Jurisdictional Note: Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages. In such jurisdictions, the above limitations may not apply to you, and you may have additional rights.

14. Dispute Resolution, Governing Law & Miscellaneous

Informal Resolution:

Before initiating any formal dispute resolution, you agree to first contact us at team@lingofable.com to attempt to resolve the issue informally. We will make good-faith efforts to resolve disputes within 30 days.

Governing Law:

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Lingofable is incorporated, without regard to conflict of law principles.

Miscellaneous:

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Lingofable
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect
• No Waiver: Failure to enforce any provision does not waive our right to enforce it later
• Assignment: You may not assign these Terms; we may assign them to affiliates or successors
• Survival: Sections that should reasonably survive termination (including liability limitations) will continue to apply
